The strata covered all the insurance costs except the moving of the furniture for carpet replace ment. The unit below was rented and the owner is making a claim of lost rent when his tenant refused to pay rent until the work was completed. From flooding to final repair was 6 months; the tenant refused to pay rent for the last 3 of those months. Has the owner of the unit below any legal claims against me? To my knowledge he has no insurance and the tenant did not move out of the unit during repairs.?
Your post does not say which pipes burst. Were they pipes for which the strata corporation is responsible or were they yours, like a toilet supply line or dishwasher supply hose? There are fine lines of responsibility in the area of insurance and the best suggestion I can offer is that you call a lawyer who specializes in condominium law. My experience tells me that a good lawyer will save you a ton of money and anguish and I would suggest Shawn Smith at Cleveland & Doan in White Rock unless you have someone you prefer.
