Dealing with Defects in your New Home

When you purchase a brand new property, things may be far from perfect. You may find that there are many finishing problems that you spot over time. While it may be annoying to have so many problems, especially when you pay big bucks to live in a new property, the good news is that there are some remedies available to you.

Depending on the home warranty company your builder has contracted with there are established guidelines as to what is acceptable and what your builder will need to fix. The best way to find out these guidelines is to call your home warranty company or browse their website. Here is a link to the defect guidelines published by National Home Warranty:

The best way to deal with your defects is to start a list as soon as you find them. If it is something major like an electrical or plumbing issue you should call your builder right away and ask them to send someone to have a look as soon as possible. For the less urgent defects like floor gaps it is best to keep an ongoing list and call your builder to book a meeting with them at your home to review some of the outstanding defects you have noticed.

You have a year to report most of the defects, consult your warranty certificate to determine the one year warranty date. If there are any outstanding defects that your builder has not addressed or your builder has been non-responsive it is a good idea to write a letter to your home warranty company outlining your concerns prior to the one year date listed on your warranty certificate. You should also mail a duplicate copy of the letter to your builder. Your home warranty company will notify your builder with a timeline that they must adhere to or the home warranty company will generally send someone out to look at the problems and bill it back to your builder.

Why is it that today, Third-world industries are able to measure defects in parts per million (that is quality) and our building industry lags so far behind?

BC builders understand the importance of producing high quality glossy marketing material. The word quality is also used liberally in their literature, raising the expectations of the unsuspecting buyer.

Delivering quality however is a subjective matter. In the building industry, a 'quality defect' means something totally different than everywhere else in the world.

The fact of the matter is that while much has been done by government to help protect builders, nothing substantive or new has been done to protect homebuyers. If the role of senior government is to protect people, where in hell have they been?
