amalgamtion of another strata

We are a small strata. Our units were built 11 years ago. THis summer a builder started 4 new units on the lot next to ours and came to tell us that these new units will be part of our strata and that we will have to put up our fees. Our land title does not show that we are a phased development and we really want to stop this from happening. Does anybody have any suggestions?

Two things you need to find out are: 1. did the developer disclose the potential for new phases in his disclosure atatement filed with the Supt. of Real Estate ? - If not, the developer may be subject to investigation and prosecution by the Supt., and 2. is there anything filed against the strata lots and/or strata corporation common property at the Land Title office that may permit the developer to do what he plans to do ? (You may need a lawyer to determine this or lead you through it but it is simple to do and shouldn't cost much.)
