It's ok for one but not the other? Who do they think they are.

The inspections are not completed and it looks like they were wrong. I wanted to sell and could not because of this and asked council if i could rent until it was determined one way or the other. They refused even though i told them i could not afford to keep up payments on the mortgagge or strata fees while it sits empty. It is a 55 plus building with "NO RENTALS". There is a hardship rule bit they still said no. I had no choice but to move my mother who lives in our building there who had just suffered a stroke and was ill and sell her place. Not two months later i read in the minutes they have allowed someone to rent for the same reasons i had. What can i do? I want to sue them but it costs so much for lawyers and i don't know if it would be worth it.

No. It seems that my mother in law is settles and I can't keep moving her. Council's refusal to let us rent and then allowing another is really disturbing and i guess there is not much i can do. It ended up costing me money, but they don't care.
The one that was allowed to rent, may have been a family member, son daughter, they would fall under Exemption from Rental Restriction Bylaw section.
You stated that you wanted to sell but could not because of this issue, just because you want to sell but cannot afford two places does not entitle you to an exemption under the Rental Restriction section.
What I would do, is write to your strata council asking for a reason that the other unit was allowed to rent. More than likely you will find the renter was a family member. If it is not a family member it could be that only a certain number of units can be rented at once and that number was reached when you approached the council.
There are several reasons one can and one can't, the best solution is to contact council and find out why.
